Keep Your Home Safe

Many times, we take for granted that our homes are safe. Unfortunately, if a break-in occurs, our feelings of safety are shattered. Here are some tips to help discourage a break-in and to help you and your family feel safe in the new year!
  1. Use a Solid Core or Metal Door for all exterior doors or entry doors. Also, make sure that these doors have the following: heavy-duty deadbolts with a one inch throw bolt, heavy-duty knob-in-lock sets with dead latch mechanisms, heavy-duty strike plate with four, 3 inch screws to ensure that it is properly secured into the door-frame, wide angle 160 degree peephole mounted no higher than 58 inches.
  2. Ensure that all sliding glass doors have secure locks and a secondary blocking device. Make sure they open properly and are properly secured to the frame.
  3. Do not leave windows unlocked at any time. Always make sure that your windows are kept down and locked. Since windows don't use locks, use a stick or dowel as a secondary blocking device on your window as well. When keeping a window open for ventilation, keep it open no more than 6 inches and make sure that the blocking device is in place. Don't leave windows open that are close enough to a door for an intruder to unlock using your open window.
  4. Don't hide keys outside your home. Find a trusted neighbor to keep a key for you. Be a trusted neighbor as well. Sometimes a watchful or nosy neighbor might just be what keeps burglars away.
  5. When on vacation, have someone pick up newspapers, mail and fliers and ask a neighbor to park their car in your driveway once or twice. Use light timers inside so that the lights go on and off randomly.
  6. Use plenty of outdoor lighting on pathways and near doors and windows. Make sure that lights have 100 foot of visibility and are motion activated.
  7. Have an alarm system installed and monitored. Use stickers and lawn signs around your home as well.
  8. In case you do have a burglary, keep your valuable and electronics well inventoried. Take pictures or videos and make sure you write down or show the serial number of these items. Update your inventory regularly and keep a copy of this inventory in location off sight such as a safety deposit box.
For questions on security system installation in the Tulsa, OK area contact Tory Tipp of TNT Security at 918-313-4074 or torytipp@yahoo.com.

FHA making more changes?

On December 2, 2009 HUD Secretary Shaun Donovan spoke at a hearing before the House Committee on Finance. I will summarize his proposed changes for FHA.

Understand that at this point, it is just a proposal, however, I do believe that some of these changes will transpire.

Reduce seller concessions to 3% (now at 6%)
Raise the minimum FICO score
Increase the minimum down payment
Increase to the upfront mortgage insurance premium
Require lender’s to have more “skin in the game” holding them more financially accountable for their origination quality.

Your Rights During a Move!

When you or a moving company moves your household goods over the interstate, there are certain rights and responsibilities that you and the moving company have, according to the Federal Highway Administration.

Although moving companies are not required to provide an estimate, you may ask for one. If you request a binding estimate, and the mover is willing to provide one, they has the right to charge you for a detailed estimate. A binding estimate must clearly describe all moving, shipping and other services provided. With a binding estimate, you are not required to pay more than the amount on the estimate, however, should anything change or need to be added, that is not clearly on the estimate, the charges may change. To ensure that the binding estimate is effective, it must be in writing and a copy must have been available to you before you move.

Every mover is required by law to prepare a bill of lading for any shipment it transports. The bill of lading is the contract between you and the mover. The information that is listed on the bill of lading is required to be the same as that on the order for service, which is required as well. You must be provided with a copy of the bill of lading before the mover loads your furniture. You have the responsibility to read the bill of lading before you accept it.

As a customer, if the moving company doesn’t write an inventory of everything in the shipment, you should do one yourself. As part of the inventory, list the condition of all items. Companies that create an inventory will usually ask you to sign each page to ensure that everything is correct. If you disagree with anything, make a note on the inventory and initial it. You should receive a copy of this inventory. At the time of delivery, check the inventory to verify that everything was delivered in the same condition in which it was picked up.

Moving companies are required to assume liability for the value of any goods that they transport. There are, however, different levels of liability. Make sure you are aware of these levels and the cost for each one.

For more information or for an estimate for residential or commercial moving services in the Tulsa, OK area, contact Mike Ellingson or Mike Steinberg at Relocation LLC at 918-459-6683 or www.relocationllc.net.

Insurance Claims

How Do I Handle an Insurance Claim on my Homeowner's Policy? Many times homeowner's find that insurance adjusters can't answer questions about their policy. That is because, many times, insurance adjusters are sub-contracted by the insurance company. To help alleviate that problem, make sure that you ask plenty of questions about your policy before you purchase it. Find out what is covered and what isn't. Also keep in mind that many policies stipulate that you have to file a lawsuit within 1 year of the claim or you will waive any right to do so. If there are problems with your claim, you may need to file a lawsuit before the year is up in order to make sure that your time doesn't run out and you are stuck with repairs that you can't pay for. To avoid being put into that position, work ahead, ask questions, and do your research.

For more information about filing insurance claims or for an estimate for insurance coverage contact Mike Tedford of Tedford Insurance at 918-299-2345 or www.tedfordinsurance.com.

Protect Your Home Value During Tough Economic Times

During today's tough economic times, we constantly hear abour the suffering housing market. Keep the following tips in mind to help protect the value of your home.

  • Mow your yard.
  • Mow your neighbor's yard.
  • Keep your house painted.
  • Support your homeowner's association. This is not the time to be quibbling over inconsequential matters.
  • Watch your entry to the neighborhood. Keep it well maintained.
  • Exterior matters most- many owners will be facing difficulty finding the funds to maintain their home as they have in the past. Don't put home maintenance issues off or you might find a bigger problem with a bigger bill later. Hire home professionals if necessary.
  • Don't flood the market if you are not a necessary seller. Your presence as a home for sale (if it competes with another house in the neighborhood) could cause a seller who is desperate to sell to become more desperate and drop their price further to compete.
  • Variety of selection is important.
  • Talk up the neighborhood! What you say to your friends is as important as any house advertisement.
  • Never say "They will never get that!" to anyone...EVER! You should HOPE AND PRAY they DO!

Many first-time home buyers that took advantage of the $8000 tax credit a year ago are still waiting for their refund. Most of these buyers amended their 2008 tax returns. The IRS says that all amended returns are reviewed by hand, therefore it is taking longer than normal.

Too Much Stuff!

It is all too common to hear someone say, I have way too much stuff! Some people hoard, others save “just in case”, and many find out they have too much stuff when they have to move. Whatever your reasons, any time is the perfect time to go through that stuff and figure out what to do with it. Here are your five basic options: Keep it, Store it, Sell, it, Donate it, and Throw it Away. The hard part is trying to put that stuff in the right category. First, ask yourself these questions:

  • Does this item add positive value to my life or does it make me feel bad?
  • Does this item have sentimental value? Is it a family heirloom?
  • Have I used this item or worn these clothes in the last year?

If the item is in the keep pile consider storing it. Larger items or items that you decide to keep but still don’t have room for can be put into storage. Remember to think about insurance coverage and special needs for certain items, such as temperature, parking, etc.

If you are getting rid of the item, follow these basic rules to categorize that “stuff”!

  • Throw it away if it is torn, ripped, broken, or stained.
  • Sell it if it is something that you think someone else would buy or could imagine someone else using. These items can be sold in a garage sale, consignment store, or even online.
  • Donate items that are in good shape and would be helpful to others. Places like Salvation Army and Goodwill take many donations and pick up in certain areas. Also remember that some items like children’s toys, book and videos can be donated to children’s hospitals and other organizations with needy or sick children. Be creative and check around. There are many worthwhile places to donate good used items.

For information on storage facilities, rental costs, and other storage tips call Mike Steinberg, Relocation LLC at 918-459-6683 or www.relocationllc.net.

New Luxury Real Estate Investors!

Foreign investors have been particularly interested in luxury real estate since the US economy and dollar have declined. They are able to purchase real estate in many areas of the US for half of what they would have paid a few years ago. The currency in countries such as Brazil, Canada, and France is stonger than the dollar. Foreign investors from these countries are buying luxury condo's in cities like Las Vegas, Miami, and New York City. They also buy in Texas, Arizona, and California.

Things to Consider When Building a Home!

When building a new home, there are so many decisions to make, from the location and builder to which carpet and paint to choose. Keep the following tips in mind when you decide to build a new home.
  • Location- Work with your Realtor when purchasing land and building your home to make sure that the location you desire will fit your budget as well as the style and size you want in your home. Don't find out after purchasing that you can't do what you want or that the market will not handle your specific plans.
  • Building- Select your builder carefully! Ask for recommendations from your Realtor, after all they work with builders everyday. Ask builders for referrals and contact them. Ask plenty of questions and don't be afraid to get more than one quote!
  • Products- Once you have purchased land, selected a builder, and begun the building process, there will be many products to choose. Ask about your options and shop around in advance to make sure you get what you want at the price you want. When selecting roofing products and styles- keep in mind your budget, style of home, and the weather in your area. Remember that by adding ridge vents or using certain materials you can decrease your energy costs.
  • Mortgage Options- Check with your mortgage banker to find out what mortgage options are available to you. For example, can you qualify for a VA or Rural Home Loan? Also, make sure you know your budget and how much down-payment you have. If you have less than 20% to put down, ask about loans that require less down-payment!

The Top Questions You Should Ask Your Mortgage Banker!

Most home buyer's have questions about their mortgage and the mortgage process. It is easy to get overwhelmed with the process so keep this list handy to get you started:

  • How much down-payment do I need to buy a house? If you are a Veteran or buying in a rural area you can get 100% financing. The seller is also allowed to pay your closing costs. If you are Native American you may be eligible for a Hud 184 loan. This loan requires as low as a 1.25% down-payment, depending on the loan amount. For an FHA loan, you must put down 3.5%, for Conventional a 5% down-payment is required, and Investment loans require a 20% down-payment.
  • What are Points/Origination Fees? Points and Origination Fees are additional fees paid at closing to lower your interest rate. 1 point is equal to $1000.
  • How do I find out exactly what my closing costs, fees, and other items are when I am comparing mortgage companies and rates? Ask for a Good Faith Estimate. Look at fee lines 800-900. Compare the rate, points/origination fees, and other items within that range.
  • What constitutes a rural development loan? A rural development loan is all based on the population of an area. Owasso and Glenpool, for example, are still rural and are eligible for a rural development loan. USDA Rural Development website can give you more information about any areas you are interested in.
  • How do Mortgage Bankers get paid? Generally, it is based on a commission calculated from the volume produced. The more produced, the higher percentage.

Mold! What Do I Do?

Mold is a problem that we hear about often. It is also something that causes great concern when it is found in our home or workplace. Because of potential health issues, it must be taken care of quickly. At what point, however, do you know when it becomes a legal issue and a lawsuit might be appropriate? Keep these things in mind before you contact an attorney:
  • Make sure that you inform your landlord or employer about the problem. Remember to keep proof that your landlord or employer received the information. Many times, your landlord or employer might not be aware of the problem, which can often be repaired at little cost. Make sure that you give them plenty of time to repair the problem as well. As the property owner, your insurance policy might cover the repairs. Contact your insurance agent to find out.
  • Finally, if you suspect health problems as a result of the mold, see your physician. Don’t let health problems linger and potentially get worse.
If you own a home or business, have mold problems repaired before the mold spreads, health problems result, or a lawsuit occurs.

For more information about when it is appropriate to sue over mold in your home or place of employment, contact Chuck Richardson, Richardson Law Firm at 918-633-5070 or www.richardsonlawfirmpc.com.

Improve Your Home or Move?

Right now, during these difficult economic times, many homeowners are choosing to improve their home rather than move. By doing so, when the economy changes they will have increased the value of their home and will be able to sell it at that point. There are many ways to improve your home and add value, including: repairing and replacing your roof, repainting the interior and exterior of your home, installing energy efficient products, providing curb appeal through landscaping, upgrading fixtures, and doing basic maintenance and pest control.

  • Repairing or Replacing Your Roof- Make sure that you keep your roof in good repair and when needed, replace it. Check with your roofing professional to see if you need a new roof, have venting problems, have loose shingles, or have any other roofing issues that are in need of repair.
  • Repainting- repainting your home not only helps maintain the property but it is also appealing to buyers when you decide to sell. Keep neutral colors in mind, however, so that it will be appealing to a large number of buyers.
  • Installing Energy Efficient Products- replace old windows, appliances, hot water heaters, and heating and a/c units with newer energy star rated ones. This will help decrease your energy bills and will be attractive to buyers.
  • Providing Curb Appeal through Landscaping- make sure that your landscaping is attractive to buyers. An attractive exterior can help ensure that buyers will at least take a peak inside. Also remember to provide landscaping that will look good in every season.
  • Upgrading Fixtures- this is an easy and often inexpensive way to improve your home. Replace doorknobs, cabinet pulls, light fixtures, and plumbing fixtures for newer ones.
  • Doing Basic Maintenance and Pest Control- this is one of the best ways to improve your property and prevent buyers from walking out the door. Many buyers simply don't want a "fixer upper" or problems with pests. They want it move in ready. Simple home maintenance and pest control will keep buyers interested and will help prevent more expensive repairs later.
Remember, if you don't have the time or skill, hire a professional to do needed improvements and repairs. A poor repair job won't attract buyers when you decide to sell. Check our the professionals listed below or visit www.tulsahomemaintenance.com for a complete list of professionals.

Buy Now or Wait for Lower Rates?

With memories of home mortgage rates of 16% and 18% in years past, current mortgage interest rates are at some of the lowest points in the last 25 or 30 years. At this time, mortgage interest rates are in the 5% range, depending on the type of loan obtained. For most "First Time Home Buyers," the interest rates have probably never been lower in their lifetime. Even for seasoned home buyers, current interest rates are a real bargain! Waiting for a possible drop of perhaps 1/4% of mortgage rate does not justify waiting to purchase a home when the mortgage interest rate could just as easily go up 1/4% to 1/2%. If a home purchase is a consideration, taking advantage of the current interest rates would be a wise course of action.

To discuss current mortgage rates and information contact Steve Currington of Currington Mortgage at 918-810-0092 or www.curringtonmortgage.com.

Preparing Your Landscaping For Cold Weather

When the temperature drops and cold weather months arrive, it is important to remember that our landscaping still needs attention. There are many things that we can do to prepare our landscape for the cold weather. Here are just a few:

  • Prune- it is helpful to prune some varieties of plants during the Fall and Winter months.
  • Plant- check out plant and vegetable varieties that can be planted during the cold months.
  • Mulch- remember to keep about 3 inches of mulch on your flowerbeds all year long. Mulch can help keep the roots warm and hold in moisture.
  • Container Plants- don't forget container plants. Some work well inside during cold weather and some can re-grow simply by taking a cutting of the plant.
If you have questions about preparing your landscaping for cold weather or want an estimate for landscaping services contact Nathan at Bluum Outdoor at 918-599-8500 or nathan@bluum.net.

Petition to Partition

Many times, people will purchase a property with a friend or family member, only to find that years later a strain happens in the relationship and one or both parties want to sell their share in the property. That in itself is not a big problem unless the parties disagree about what should happen with the property. When a disagreement happens that can't be resolved, each party will need to seek an attorney. Usually, it will end up before a judge. Each party will lay out their interest for the property and the judge will determine what will happen with the property, including the interest each party will have with the property. The judge can also appoint appraisers to determine the property value. Getting to this point will usually cost quite a bit of money in legal fees. To avoid this type of situation, contact an attorney to discuss plans before a contract is signed.

If you have questions regarding a Petition to Partition or other legal issues, contact David Keesling with Richardson, Richardson, Boudreaux at 492-7674 or www.rrblawok.com.

Why Do I Need a Survey When I Build a New Home or Addition?

When you decide to build an addition or a new home, you will need a survey. A survey shows where the property lines are as well as any buildings, easements, driveways, or encroachments on the property, such as a neighbor's driveway. You might say, "I don't need a survey. I have a plat map". A plat map only shows the property boundaries. It doesn't show easements or encroachments which can cause a problem with a legal title. A survey will ensure that anything you are building is not on someoone else's property or easement. It will also help if you have acreage and decide to sell some of it later.

For more information on land surveys, titles, and the closing process, contact JJ Pierce at Closings of Tulsa at 918-493-2241 or www.closingsoftulsa.com.

New Law Affecting Your Move

Mike Ellingson, owner of Relocation LLC, says local movers in Oklahoma will be facing new rules from the Oklahoma Corporation Commission requiring insurance coverage and licensing. Formerly, an inter-city moving company was exempt from licensing and insurance laws but will now face penalties and fines for not holding these policies and coverages. The law takes effect November 1st, 2009. Homeowners are often deceived by companies who present a low bid but offer no coverages for damage or loss. Research carefully before you hire a mover and make sure that you can trust them with all of your belongings. For more information on these new regulations affecting your move, for an estimate, or for moving tips, contact Mike at 918-459-6683 or www.relocationllc.net.

Incorporating Green Ideas into Your Home

When building, remodeling or replacing things in your home, eco-friendly or greeen ideas can be very easy and often inexpensive to implement. Here are some easy ways to incorporate green products into your property:

  • When building a new home, face the widest part of the building to the north or the south.
  • Place doors and windows where you will receive good cross-ventilation.
  • Ensure any attic space is well ventilated by using roof ridge vents, lighter colored roofing materials, lots of insulation, and by placing A/C ducts in the attic to absorb the heat.
  • Install an energy-efficient and properly sized heating and A/C system, make sure that duct work is correctly sealed, and use a programmable thermostat.
  • Utilize landscaping materials, plants and design that are appropriate for the climate and rainfall levels in your area.
  • Use low-flow toilets and shower heads and energy-efficient appliances.
  • Recyclable and renewable materials can be used for decking, siding, trim and more.
  • Choose green flooring materials such as concrete, bamboo, or recycled wood.
  • Replace your air-conditioning filter regularly to enhance the performance of your air conditioning system and to reduce pollutants.

Do I repair, refinish, or replace my hardwood floor?

When a good quality hardwood floor is installed properly and needed repairs are done well it provides a beautiful and durable flooring option. When hardwood flooring repairs, refinishes, and installations are not done properly or a bad product is purchased it can cause many problems. Here are some common problems with hardwood flooring and their causes:
  • Buckling is usually caused when the flooring is not given proper time to acclimate, moisture testing is not done correctly, or it is not given proper room to expand.
  • Creaking or squishy floors can be caused by incorrect floor preparation on both a concrete slab and a wood subfloor.
  • Fading and color changes can occur simply due to exposure to light over time or from failing to install from different cartons. Since cartons of hardwood flooring can come from different lots it is important for the installer to use several different cartons at a time when installing the flooring in each area.
  • Visible and Invisible defects can occur when using a poor quality hardwood floor. Although it can also occur with even the best of hardwood products, it is less likely when good quality hardwood products and good hardwood flooring installers and repair professionals are chosen.

To ensure that your hardwood floor looks beautiful for years to come, select a good quality floor, have it installed properly, and make sure all repairs are done correctly. For new hardwood flooring options, call Jim Ecrette of ProSource Flooring at 918-252-7711 or www.prosourcefloors.com/tulsa and ask for Darryl Baskin's Contractors Rate. For repair and installation of hardwood flooring in the Tulsa area, call Jonathon Knapp of Residential Repair, Inc. at 918-621-1020 or www.residentialrepairinc.com.

Autumn Pests

Many insects find their way into our homes during this time of year. They come in through crevices and cracks in roof flashing, siding, trim, vents, and any other way they can. Once they are inside the walls and structural areas of your home or business they can be very hard to exterminate. When the weather warms up they will often come inside through light fixture openings, vents, light switches, and fireplaces. Help eliminate this problem by:
  • Looking for and repairing interior and exterior cracks and crevices where pests can enter
  • Having professionals exterminate your property now to prevent further problems in the Spring
For all your pest control needs, call Duane Montgomery of Montgomery Exterminating at 918-438-4885 or www.montgomeryexterminating.com.

Tips for a Smooth Closing

Buying and Selling a home can be a stressful process, but when the closing process doesn't happen smoothly, it can add even more stress. Here are a few tips to de-stress the closing process. First, listen to the professionals. If your real estate agent or mortgage broker gives you suggestions for the closing and moving process, heed their advice. They see problems regularly and can help you avoid some of the most common problems. Second, pack and move out of the house as early in the day, or even the night before, as possible and schedule closing for the afternoon. For buyers, schedule the final walk through earlier in the day as well. This added time should help with any unplanned delays. Third, consider adding a little extra expense to your budget in case there is a delay in closing and storage or hotel costs are needed or you need to hire a professional for an unexpected home repair. Finally, ask for a final settlement statement a day or two in advance of closing so that last minute surprises are kept to a minimum.

For more information on the closing process or if you are in need of closing services, contact JJ Pierce, Closings of Tulsa, 918-493-2241.

Condominium Insurance

When purchasing insurance for your condominium, there are some important things to keep in mind. First, know your covenants and bylaws. Each condo association is different and has different covenants and bylaws. With some, if the condo is destroyed, they will rebuild the outside, but the owner is responsible for everything from the sheetrock in. This type of information will help your insurance agent determine the proper coverage for your policy. Second, remember that you may be responsible for extra fees if the condo association falls short of funds (to replace the roof, for example). That can also be added as coverage for your policy.

For more information about condo insurance, renters insurance or another type of insurance, contact Mike Tedford, Tedford Insurance, 918-299-2345, or www.tedfordinsurance.com

Fire Damage

A home or business fire is not only destructive it can also leave you wondering "what do I do next"? First, contact your insurance company and inform them of the fire and gets things going from their side. Second, get all your important documents together , especially those that have survived the fire. If they didn't survive the fire, attempt to get another copy. Third, take inventory of what was and wasn't damaged. Damaged property can be difficult and stressful to handle, so call the professionals.

The experts at PCC Cleaning and Restoration can help with fire and water restoration and even mold damage. For more information on fire and water restoration, mold damage, or helpful tips after this type of damage to your property call Roger Fisher at 918-641-1111 or visit their website at http://www.pcccr.com.

Moving with Pets

Moving can be very stressful for the homeowners and can be just as stressful on their pets. Here are some tips that can make that transition easier on you and your pet. First, keep your pet's routine as normal as possible during the packing and moving process. Second, if possible, have a friend or boarding service watch him. If not possible, avoid giving him food or water an hour or two before your trip. Third, if he will be traveling in a pet carrier, make sure there is room for him to stand up and turn around and plenty of ventilation for him to breathe. Remember to use newspaper or other absorbent material in the bottom of the carrier, in case he has an accident. Finally, remember his favorite toy!

For more moving tips or questions or to get a quote for your move, contact Mike Ellingson at 918-459-6683 or visit http://www.relocationllc.net/Default.aspx.

Pre-Nuptial Agreements

Quite often, pre-nuptial agreements are thought of as negative. In some cases, however, a pre-nup can be very helpful and even create peace of mind. A pre-nuptial agreement (also called a pre-marital agreement or pre-nup) defines to whom property belongs and can prevent legal arguments should a divorce or death occur. The agreement covers three areas: during marriage, upon divorce, and upon death of a spouse. It is very important that all parties involved have independent counsel. It is also important that everyone is honest and provides full disclosure of their assets. If these don't occur, the agreement may be invalid. You might benefit from a pre-nup if you are engaged and either own a business, have children or someone needing special care, or have many assets.

To discuss a pre-nuptial agreement or other legal issues, contact Richardson Law Firm, at 918-492-7674 or www.richardsonlawfirmpc.com.

Congressman John Sullivan Describes Obamacare

Congressman Sullivan meets with constituents at the Summit Club in Tulsa, OK to bring an update on Congressional bills and helth care.

The Obama administration has appointed 44 Czars whereas Clinton, Bush I and II, and Reagan averaged three and four czars during their terms.  Sullivan spoke in support of natural gas as a fuel source stating that the United States has a 120 year supply of natural gas.

Another topic of discussion was the Fair Tax.  Sullivan was an original co-sponsor of the Fair Tax bill.  He expects the next 5-10 years will possibly produce a substantial change in our tax system.  Due, in part, to the enormous grass roots movement for this change.

Flooring Discounts

Tulsa, Oklahoma area homeowners are looking at ways to enhance their
property values at a time when moving is not the best option for
everyone. Local real estate broker, real estate investor, and property
manager, Darryl Baskin, says many homeowners are using the "improve
don't move" philosophy and choosing to remodel their homes instead.
"This is a great time to buy a new home if you're looking to get a
larger home or if you are a first time home buyer, but for some people
moving is not the best option right now." says Baskin. local
retailers are pushing new products and ideas to these property owners
eager for a change in the look and style of their home.

"Green" building options are one of the most popular choices for
remodeling today. A local wholesale outlet, ProSource Flooring
Supply, says contractors are requesting more products that are
natural and considered renewable sources. Space "ProSource has
introduced 59 new styles of hardwood flooring this year alone which
includes a Green Select line of products," Says Jim Ecrette, ProSource
Tulsa manager. These products look good and are better for your
family. Baskin has offered his contractor pricing to many of his
clients and friends and notes a higher demand than in the past.

NEW APPRAISAL RULES COME WITH COSTS

New Appraisal Rules Come With Costs
By Kenneth R. HarneySaturday, May 16, 2009
How about this scenario the next time you refinance or apply for a new mortgage: The real estate appraisal that used to cost you $325 now costs $450, even though the appraiser doing the work is getting only $175 or $200.
Plus, your appraisal-related charges may now be subject to add-on fees that you have never heard of -- $50 to $100 extra in "no show" penalties if you get stuck in traffic and miss your appointment with the appraiser. Or an extra $50 to $150 if the property is worth more than $500,000.
On top of all this, your mortgage loan officer requires you to pay for the appraisal upfront with a credit or debit card, rather than including the fee with the usual lender origination costs at settlement. In some cases, your card may be charged more than the anticipated cost of the appraisal -- leaving debit-card holders in a potential overdraft situation.
Worse yet, the person conducting your appraisal may be new to the field -- willing to work for a cut rate -- and may not be as familiar with local value trends and pricing adjustments as an appraiser with more experience. If your mortgage application is denied by one lender, you could be forced to pay for a second full appraisal because the new lender may not accept the first one.
That scenario is now reality, according to critics of the new appraisal rules imposed nationwide on May 1 by Fannie Mae and Freddie Mac. Advocates of the rules vigorously deny that the new system is flawed and say any increase in appraisal costs should be manageable for most consumers.
The rules, which go by the name Home Valuation Code of Conduct, are intended to improve the accuracy of appraisals by eliminating pressure on appraisers from loan officers. The code pushes most large lenders to use third-party "appraisal management companies" that contract with networks of independent appraisers around the country who have no direct contact with retail loan officers or mortgage brokers.
Mortgage brokers -- who formerly chose appraisers and kept a competitive eye on appraisal fees -- claim that Fannie's and Freddie's rules are adding 20 percent to 30 percent to consumers' appraisal costs. Jeffrey T. Hawk, vice president of Maryland Mutual Mortgage in Forest Hill, Md., north of Baltimore, said a standard appraisal that previously went for $325 jumped to $400 or more May 1 when he began using management company appraisers.
Some applicants also are balking at handing over credit card information upfront when they're not completely sure what the charge will be. "I lost three clients the first week" because of the credit card requirement, Hawk said.
Buddy McCombs, senior vice president of EverBank, a Jacksonville, Fla., lender that buys loans originated by Hawk's firm and now contracts with management companies for appraisals, conceded "there's probably a little increased cost" with the new system, "but I don't think it's devastating."
"What's terrible is what's happening to [long-established] appraisers who won't work for the low fees," said James Facchini of American Pacific Appraisal in Sacramento. "On May 1, I lost almost my entire customer base" -- mortgage brokers who now can't pick up a phone and order an appraisal from him.
Instead Facchini and other appraisers either have to sign up with management companies or find other employment. What "really bothers me is that the consumer has no idea what's going on," Facchini said. After he signed up with one management company, he said, two borrowers commented to him after he finished his appraisal, "Wow, you really charge a lot."
They were each being hit with $550 appraisal fees, while he was getting just $250 through the management company. As he sees it, that leaves $300 of "slush" somewhere in the process -- some going to the management company, but the rest probably "flowing to the lender for doing absolutely nothing."
Rich Kuegler, a vice president at MDA Lending Solutions, a national appraisal management company, said payments to firms such as his are compensation for creating, managing and reviewing a network of thousands of appraisers -- MDA has 9,000 under contract across the country -- and for the "processing and administrative" costs that have been taken off the backs of brokers and lenders.
As to appraisers' complaints about fees, Kuegler said, "we offer the ability to have a steady stream of work, training and support." In other words, appraisers can expect to make up in volume what they're sacrificing per assignment. (Kuegler has also invented a 36 hour day, never knew that Lincoln freed the slaves, and his business plan is modeled after southern plantations)

How Far Will the Government Go?

Just how far will the government go to meddle in the economy? This article suggests pretty far. "Cash for keys" is a common practice for lenders to remove tenants and foreclosed homeowners with less hassle. Now, the US Government is providing what could be called a relocation package for homeowners who can't pay their mortgage.
